BoldHR® Terms and Conditions 2023

GENERAL

The laws of the state of Victoria govern this agreement. Should any part of this agreement be determined by a court to be invalid or unenforceable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of a managing director of BoldHR®. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to BoldHR® under this agreement.

REFERENCES

  • “The Supplier”, “us”, “our” and “we” refers to BoldHR®
  • “The Client” refers to any individual or organisation paying for BoldHR®’s goods and services, also referred to as “you” or “your”.
  • “Events” means Training, Facilitation, Speaking and AskMeAnything events.  Where a series or program of Events are engaged, the Event is considered to have commenced from the first date in the series.
  • “Membership” or “Members” includes Bronze, Silver, Gold and Platinum mentoring and coaching clients of the Level Up Program.

SATISFACTION GUARANTEE

We are confident of the value we bring to all our clients, however, if you have fully engaged with the relevant onboarding activities and are still not satisfied please notify BoldHR® within 30 days of engagement and you’ll get your money back, minus any third party administration fees.

CHANGES AND AMENDMENTS

By The Client

Changes to 1:1 scheduled sessions are subject to 48hrs notice or may be forfeited, along with any fees paid for that session. Program Pause If you need to defer your Membership for any reason, you can do so by notifying us in writing.  Any sessions that you have not used will be credited to you for use for up to 12 months from your last session.  If you are on a payment plan, you must still complete your plan to take a pause unless otherwise agreed.

Group Mentoring and Keynote sessions will be scheduled around public holidays in Australia (all states) and we regret we cannot accommodate change requests to these events. If for any reason we deem it necessary to do so, BoldHR® may change any program or event delivery dates and/or time by notifying you in writing and you shall have no claim upon us for compensation.

CANCELLATIONS

By The Client

If you choose to cancel your membership or event for any reason within 30 calendar days of confirmation (the “cooling-off period”), we will refund you the total amount you have paid to BoldHR®, minus the cost of any services you may have received as part of the program plus any third-party administration fees.  Please allow up to 10 days for your refund to be processed.

Mentoring & Coaching Programs

  • Mentoring & Coaching 1:1 sessions are subject to 48hrs cancellation / reschedule notice or may be forfeited.
  • Mentoring & Coaching 1:1 sessions that are continually rescheduled may also be forfeited.
  • If you have entered into a monthly payment plan, you may cancel or pause your program after your 6th payment by notifying us in writing.
  • Refunds are not available for digital products
 

Training and Events cancellation

  • Once scheduled, Event bookings are non-refundable.
  • Rescheduling is based on availability and at BoldHR®’s discretion.
 

Publicly available courses & purchases

  • Refunds are not available for digital products or online purchases, including online courses or memberships, unless the course has not yet commenced.
  • Mentoring & Coaching upgrades or additional items are charged as a one-off fee.
  • Memberships that pay by month are subject to a minimum 6 months commitment after which you can cancel at any time.

Program cancellation

  • Once scheduled, all Facilitation and Speaking bookings are subject to cancellation fees: 50% due if cancelled within 30 days of planned event, 100% due if cancelled within 10 days.
  • If for any reason we deem it necessary to do so, BoldHR® may cancel your program or event by notifying you in writing. In this case we will refund the total amount you have paid, less the cost of any mentoring, coaching, keynote speaking, facilitation or training that you have received, up to this date, and you shall have no claim upon us for compensation.

If for any reason we deem it necessary to do so, we may cancel the program, training or event by notifying you in writing.  Should this occur we will refund the total amounts you have paid, less the cost of any mentoring, group coaching sessions and Masterclasses you have been invited to attend, up to this date, and you shall have no claim upon us for compensation.

PAYMENT TERMS

Event bookings and Memberships cannot be secured without receipt of agreed payment, nor commencement of any onboarding activity unless by prior agreement.

Payment in Full:

Unless otherwise agreed, Events are to be paid for in full to secure the Event booking. Upon engagement, Level Up Members can elect pay in Full or in Instalments.

Payment in Instalments:

A payment plan agreement is for a fixed period and to the extent permitted by law cannot be terminated by the client prior to the completion of the agreed payment plan.  Instalment payments must be finalised within the agreed payment plan term.

Failure to Pay:

Without prejudice to any other right or remedy that it may have, if the Client fails to pay as agreed, BoldHR® may notifying you in writing of our intention to:

  • Suspend Membership until outstanding payments have been made in full;
  • Terminate the Agreement with immediate effect;
  • Engage debt collection services from 90 days in arrears
